L’insegnamento si incentrerà sulle istituzioni di diritto privato.
Considerando che gli utenti sono studenti di Economia, si impronterà lo
studio delle tematiche, avendo sempre riguardo alle ricadute nella realtà
economica della normativa di diritto interno e sovranazionale. Si porrà
l'accento sulle fonti di produzione del diritto, sottolineando che,
nell'epoca della globalizzazione, il futuro professionista, ai fini della
risoluzione del problema pratico, dovrà esaminare sia la normativa
nazionale- dunque, anche i regolamenti delle autorità amministrative
indipendenti-, sia la normativa sovranazionale. Si incentrerà l'attenzione
sulle tematiche delle situazioni giuridiche soggettive, dei contratti, delle
obbligazioni e della responsabilità civile. L'analisi del diritto di famiglia e
del diritto delle successioni sarà in linea con l'obiettivo di formare
studenti di Economia: si affronteranno aspetti strettamente rilevanti ed
in linea con l'offerta formativa globale, quali l'impresa familiare ed il patto
di famiglia. In fase avanzata dell’insegnamento, si forniranno agli studenti
testi di pronunce giurisprudenziali, per commentarle in sede di
esercitazioni. Si approfondiranno le diverse modalità di risoluzione
stragiudiziale delle controversie, insistendo sulla disciplina del settore
finanziario, bancario ed assicurativo.

studenti dovranno studiare unicamente le parti di testo, relative al
programma di studio indicato. All’inizio dell’insegnamento la docente

L’utilizzazione di altri manuali deve essere concordata con il docente. 3.
La consultazione di un codice civile aggiornato è indispensabile per la
preparazione dell’esame. 4. La docente fornirà, in aula, agli studenti
corsisti testi di pronunce giurisprudenziali che saranno commentate e
discusse, durante le esercitazioni. 5. Non ci sono differenze di testi per gli
studenti non frequentanti. Il materiale aggiuntivo suddetto verrà altresì
caricato sulla pagina web della docente, per consentirne la consultazione.

A) L’insegnamento di DIRITTO PRIVATO intende trasferire le conoscenze
di base necessarie per: l’acquisizione della padronanza del lessico
giuridico; la comprensione e la conoscenza: del sistema delle fonti di
produzione delle norme giuridiche; dei principali istituti del diritto civile;
dei principi basilari dell’ordinamento giudiziario italiano e dei sistemi di
risoluzione alternativa delle controversie giuridiche, in particolare nel
settore bancario e finanziario; la capacità di individuare, in linea con le
norme di diritto internazionale privato, sia l’organo giudicante
competente, sia la disciplina applicabile, nei casi di risoluzione di
controversie transfrontaliere.
B) Abilità e conoscenze derivanti dalla frequenza dell’insegnamento. Al
termine dell’insegnamento lo studente acquisirà: la padronanza dei
concetti giuridici fondamentali; la capacità di capire, con autonomia di
giudizio e senso critico, quale sia la normativa più pertinente da applicare
al caso concreto; la comprensione della necessità di aggiornarsi
costantemente sull’evoluzione della normativa, di diritto europeo e
nazionale; la consapevolezza dei profili di internazionalità della disciplina
privatistica; la capacità di consultare, anche in chiave critica, le pronunce
giurisprudenziali; la terminologia tecnica appropriata, per comunicare e
interagire con i diversi interlocutori, nel mondo del lavoro; l’abilità
comunicativa: intesa quale la capacità di
argomentare coerentemente soluzioni a problematiche giuridiche; la
Capacità di apprendimento: intesa quale l’abilità di utilizzare gli strumenti
didattici, messi a sua disposizione: sia i libri di testo, sia la
partecipazione a lezioni, ad esercitazioni su temi specifici, a convegni ed
a testimonianze di imprenditori, professionisti o giuristi; sia il colloquio
diretto e costante con il docente.

La didattica si basa sulla seguente articolazione: 1. Lezioni frontali e/o
virtuali (n. 70 ore) Le lezioni, ciascuna di 2 ore, sono divise in due parti.
Nella prima parte, il docente illustra l’argomento con una lezione frontale
e/o virtuale; nella seconda parte, l’argomento viene ripreso ed
approfondito, mediante la sottoposizione agli studenti di casi pratici ed
esempi diretti a far cogliere l’effettiva utilizzazione pratica dell’istituto. Gli
studenti vengono coinvolti e sollecitati a riflettere sui temi proposti ed a
partecipare attivamente alla lezione, esprimendo opinioni. 2.
Esercitazioni. (20 ore) Esse sono dirette a verificare l’effettiva
comprensione degli argomenti trattati e lo stadio di apprendimento.
Vengono, inoltre, periodicamente effettuate delle simulazioni di esame,
dirette a sollecitare gli studenti all’autovalutazione. 3. Testimonianze
applicative: imprenditori, rappresentanti istituzionali, docenti universitari,
professionisti di consolidata esperienza sono invitati a partecipare come
relatori ospiti alla lezione, per approfondire, grazie alle loro esperienze
professionali, specifici argomenti dell’insegnamento. 4. Studio individuale
Gli studenti integrano le conoscenze acquisite in aula, con lo studio
individuale del libro di testo e la lettura di documenti di approfondimento,
segnalati dal docente al fine di favorire autonome capacità di
apprendimento 5. Frequenza dell’insegnamento La frequenza
dell’insegnamento non è obbligatoria. Gli studenti che avranno
partecipato al 75 % delle lezioni potranno svolgere l’esame,
suddividendolo in due moduli, da discutere in due date diverse di esame,
i cui contenuti saranno comunicati agli studenti corsisti in aula

La prova finale consiste in un colloquio orale su ciascuna delle parti del
programma. Metodo di valutazione: 1. Gli studenti dovranno dimostrare:
Il possesso di un’adeguata conoscenza degli argomenti del programma,
applicando in maniera pertinente le teorie e i modelli concettuali oggetto
di studio; la comprensione degli istituti e la padronanza delle relative
applicazioni; la capacità di risolvere questioni giuridiche, utilizzando le
conoscenze acquisite, operando collegamenti critici tra gli argomenti ed
applicando gli strumenti forniti; la capacità di organizzazione il discorso e
l’utilizzo del lessico giuridico, durante l’esposizione . 2. Il superamento
dell’esame si otterrà con un voto minimo di 18 e il voto massimo
dell’esito dell’esame 30. Per poter conseguire la sufficienza è necessario
avere la conoscenza minima ed aver acquisito la comprensione dei più
importanti istituti del diritto privato. 3. Nell'esaminare la preparazione
degli studenti Erasmus, si valuterà positivamente la comparazione della
disciplina italiana degli istituti civilistici con la disciplina del paese di
origine. Durante i colloqui di orientamento dello studio di tali studenti,
essi verranno orientati a soffermarsi, in particolar modo, sulla disciplina di
diritto interno di derivazione europea

1) Si inviteranno gli studenti Erasmus ad incontrare la docente
settimanalmente, per verificare la comprensione delle tematiche oggetto
di studio, per sviluppare un colloquio critico di comparazione con gli
istituti del Paese di origine e per perfezionare il linguaggio tecnico
giuridico. Al fine di agevolare lo studio dei discenti Erasmus, si proporrà
loro un testo in lingua inglese di riferimento.
2).Materiale didattico aggiuntivo. Pronunce giurisprudenziali e documenti
, forniti dal docente, concernenti eventuali novità normative, non
menzionate nei libri di testo.
3). Tesi di laurea. Tutti gli istituti giuridici affrontati nell’insegnamento si
prestano alla redazione di tesi di laurea, i cui argomenti specifici verranno
concordati con il docente, sulla base delle preferenze espresse dal/la
candidato/a.
4). Per ogni dubbio o incomprensione gli studenti sono vivamente invitati
a utilizzare le ore di ricevimento del docente, al quale è altresì possibile
in ogni momento rivolgersi, per gli stessi fini, utilizzando l’indirizzo di
posta elettronica pubblicato sul sito.
5). Si invitano fortemente gli studenti a frequentare l’insegnamento ed a
partecipare alle esercitazioni, durante le quali si svolgeranno simulazioni
d’esame e si ripeteranno gli argomenti, spiegati in aula, sui quali gli
studenti abbiano ancora dubbi.

There are no requirements, nor particular prerequisites

Teaching is articulated as follows:
1. The lectures (70 Hours), each of two hours, are divided into two parts.
In the first part, the professor introduces the subject; in the second part,
the topic it is explored through the examination of case studies and
examples. The topics are treated in particular taking into account the
economic reality and business relationships. Students are involved and
encouraged to reflect on the proposed themes and to participate actively
in class by asking questions, by formulating examples, by expressing
judgments.
2. Exercises (20 hours) At the end of the discussion of each part will be
carried out a test to verify the understanding of the topics and the
learning stage. Since this teaching is frequented by students of the first
year, special attention is put to verify the validity of method of studying
of each student.
3. Meetings with professionals and entrepreneurs Meetings are held with
other scholars, with professionals and entrepreneurs on specific issues to
enable students to have an operational approach and to stimulate their
attention to the matter.
4. Self-study: students integrate the knowledge and skills acquired in the
classroom with individual study of the textbook, and reading related
documents recommended by the teacher in order to promote
autonomous learning ability
5. Course attendante
Course attendance is not mandatory. Students who have attended 75%
of the lessons will be able to take the exam, dividing it into two modules,
to be discussed on two different exam dates. The subdivision of the
topics for the two modules will be communicated to the students, during
the course of the teaching.

The final exam will be oral.
Students must demonstrate:
- Possession of an adequate knowledge on program topics, making
critical links between them;
- An understanding of the institutions and of the mastery of their
applications
- The ability to solve elementary legal issues, using the knowledge
gained and applying the tools provided.- the ability to organise the speech and the use of legal vocabulary during
the exhibition.
2. The successful outcome of the examination will be obtained with a
minimum vote of 18 and the maximum vote is 30. In order to achieve
sufficiency, it is necessary to have the minimum knowledge and
understanding of the most important institutions of private law

1) Erasmus students will be invited to meet with the professor on a weekly basis in order to check their understanding of the topics being studied, to develop a critical comparison with the institutions in their country of origin and to refine their technical legal language. In order to facilitate the study of Erasmus students, an English language reference text will be offered to them. 2).Additional teaching material. Jurisprudential pronouncements and documents, provided by the professor, concerning any new legislation not mentioned in the textbooks. 3). Thesis. All the legal institutes dealt with in the course lend themselves to the drafting of dissertations, the specific topics of which will be agreed with the lecturer, on the basis of the preferences expressed by the candidate. 4). In the event of any doubts or incomprehension, students are strongly advised to make use of the professor's reception hours, whom they can also contact at any time, for the same purposes, using the e-mail address published on the website. 5). Students are strongly encouraged to attend the course and to participate in the tutorials, during which exam simulations will be carried out and any topics explained in the classroom on which students still have doubts will be repeated.
