| Contenuti | Il corso di Diritto privato del Web ha ad oggetto lo studio dell’impatto del web sugli istituti del diritto privato. Esso si propone di offrire un’approfondita ricostruzione delle nozioni privatistiche classiche alla luce delle nuove tecnologie e dei social network che introducono nuove esigenze di tutela e di regolamentazione in una realtà sempre più digitale e tecnologica. Particolare attenzione sarà rivolta alle tematiche relative alla tutela dell’accesso alla rete, al digital divide, alla reputazione nel web, alle criptovalute e alle modalità di circolazione delle medesime, al commercio elettronico, alla pubblicità commerciale e ai suoi contratti, alla corretta informazione (con riferimento all’influencer marketing), alle pratiche commerciali sleali e al Digital Market Act. |
| Testi di riferimento | Durante il corso, in virtù della continua evoluzione della materia, sarà distribuito materiale didattico di studio e di approfondimento. Gli studenti si dedicheranno unicamente alle parti del programma indicate dal docente. Per gli studenti non frequentanti il programma è il medesimo. Il materiale di studio sarà a messo disposizione dello studente. Si invitano gli studenti non corsisti a contattare la docente in merito a qualunque perplessità. Per gli studenti Erasmus è previsto un programma di studio personalizzato. |
| Obiettivi formativi | - Conoscenza e comprensione del lessico giuridico specialistico e degli elementi caratterizzanti i principali istituti giuridici relativi al Diritto privato del web. - Capacità di applicare conoscenza e comprensione all’inquadramento dei conflitti di interesse e alla ricerca di soluzioni giuridicamente fondate. Capacità trasversali Autonomia di giudizio: intesa come capacità di collegare le nozioni teoriche − apprese a lezione – ai rapporti giuridici che trovano fonte nel web, riconoscendo il ruolo delle regole giuridiche nel disciplinare la convivenza civile e la soluzione dei conflitti. - Abilità comunicative: si insiste sulla necessità di porre la massima attenzione sull’acquisizione del linguaggio tecnico-giuridico specialistico che va ad aggiungersi a quello di giuridico di base già acquisito nei corsi triennali. - Capacità di apprendimento: è necessario che lo studente utilizzi tutti gli strumenti didattici messi a sua disposizione – lezioni frontali, manualistica, testi normativi, colloqui con il docente negli orari di ricevimento – al fine di acquisire una corretta metodica di inquadramento giuridico dei fatti della vita reale. |
| Prerequisiti | Non sono previste propedeuticità, né particolari prerequisiti. |
| Metodi didattici | La didattica si basa sulla seguente articolazione: I. Lezioni frontali (56 ore) - Le lezioni di 2 ore ciascuna sono partecipate ed articolate con il coinvolgimento degli studenti; essi sono invitati a partecipare alla discussione con autonomia di giudizio, esprimendo idee, formulando domande, presentando esempi. La suddetta modalità è da preferirsi dal punto di vista didattico perché impegna lo studente attivamente sin dalla lezione frontale, stimolando l’interazione e la riflessione. II. Esercitazioni (20 ore) - Simulazioni, gruppi di lavoro e case study: gli studenti sono divisi in gruppi e affrontano un case study, sotto forma di testo consegnato dal docente, nel quale sono illustrate alcune situazioni “critiche” esemplificative delle tematiche oggetto del corso; III. gli studenti in gruppo elaborano, simulando un intervento professionale e/o consulenziale, una presentazione esplicativa nella quale, individuano gli istituti giuridici di riferimento e li applicano, esponendo, poi, l’analisi giuridica effettuata e le soluzioni proposte. - Presentazioni ed esposizione in aula: alcuni dei gruppi presentano in aula il lavoro svolto e sviluppano, con il coordinamento del docente, una discussione e un confronto fra le diverse ipotesi. Particolare enfasi viene dedicata alla coerenza fra contenuti esposti e abilità comunicative. IV. Testimonianze applicative. Imprenditori, manager, rappresentanti istituzionali, docenti universitari, professionisti di consolidata esperienza, sono invitati a partecipare come relatori ospiti alla lezione, per approfondire, grazie alle loro esperienze professionali, specifici argomenti del corso e/o casi giurisprudenziali. IV. Studio individuale. Agli studenti sono suggeriti alcuni libri di testo e siti web giuridici, funzionali allo sviluppo di autonome capacità di apprendimento. V. Frequenza dell’insegnamento. La frequenza dell’insegnamento non è obbligatoria. |

| Altre informazioni | Gli studenti sono seguiti individualmente nella preparazione dell’esame mediante l’attività di tutoraggio che si svolge durante l’intero anno accademico. Gli studenti Erasmus sono invitati ad incontri settimanali al fine di verificare la comprensione delle tematiche, incentivare la comparazione con gli analoghi istituti del Paese di origine, anche con il confronto con i colleghi, e perfezionare il linguaggio tecnico giuridico. Essi possono, a loro discrezione, sostenere la prova di verifica finale in lingua inglese. Tesi magistrale La tesi magistrale consiste nell’analisi individuale di uno degli istituti giuridici affrontati nell’insegnamento, i cui argomenti specifici sono concordati con il docente-Relatore che, sulla base delle preferenze espresse dallo studente e unitamente al Correlatore, seguirà la preparazione dell’elaborato. In particolare la tesi dovrà manifestare la maturità critica, letteraria, tecnico-scientifica corrispondente alle figure culturali e professionali specifiche del corso di laurea magistrale e dovrà essere elaborata in modo originale dallo studente. |
| Programma esteso | Il corso è così articolato: - Web e persona; -Web, social network e diritti della persona; - Web e dematerializzazione dei diritti reali: nuovi beni e nuove “ricchezze”; - Web ed attività contrattuale. | Contents | The Private Law of the Web course focuses on the study of the impact of the web on private law institutions. It aims to offer an in-depth reconstruction of classical private law notions in the light of new technologies and social networks that introduce new protection and regulation requirements in an increasingly digital and technological reality. Particular attention will be paid to issues related to the protection of access to the web, the digital divide, reputation on the web, cryptocurrencies and how they circulate, e-commerce, commercial advertising and its contracts, fair information (with reference to influencer marketing), unfair commercial practices and the Digital Market Act. |
| Textbook and course materials | During the course, due to the continuous evolution of the subject, study and in-depth study material will be distributed. Students will only devote themselves to the parts of the programme indicated by the lecturer. For non-attending students, the syllabus is the same. Study material will be made available to the student. Non-attending students are invited to contact the lecturer with any questions. A personalised study programme is provided for Erasmus students. |
| Course objectives | - Knowledge and understanding of the specialised legal vocabulary and the elements characterising the main legal institutes relating to Private Web Law. - Ability to apply knowledge and understanding to the framing of conflicts of interest and the search for legally sound solutions. Transversal skills Autonomy of judgement: understood as the ability to link theoretical notions - learnt in lectures - to the legal relations that find their source in the web, recognising the role of legal rules in regulating civil coexistence and conflict resolution. - Communication skills: emphasis is placed on the acquisition of specialised technical-legal language in addition to the basic legal language already acquired in the three-year courses. - Learning ability: it is necessary for the student to use all the didactic tools made available to him/her - frontal lessons, manuals, normative texts, talks with the lecturer during office hours - in order to acquire a correct method of legal framing of real-life facts. |

| Teaching methods | Teaching is based on the following articulation: I. Lectures (56 hours) - Lectures of 2 hours each are participative and articulated with the involvement of the students; they are invited to take part in the discussion with autonomy of judgement, expressing ideas, formulating questions, presenting examples. This mode is preferred from a didactic point of view because it actively engages the student from the frontal lesson, stimulating interaction and reflection. II. Exercises (20 hours) - Simulations, working groups and case studies: students are divided into groups and tackle a case study, in the form of a text delivered by the lecturer, in which a number of "critical" situations illustrative of the topics covered by the course are illustrated; III. by simulating a professional and/or consultancy intervention, students in groups prepare an explanatory presentation in which, they identify the reference legal institutions and apply them, then presenting the legal analysis carried out and the solutions proposed. - Classroom presentation and exposition: some of the groups present their work in the classroom and develop, under the coordination of the lecturer, a discussion and comparison of the various hypotheses. Particular emphasis is placed on coherence between the content presented and communication skills. IV. Application Testimonials. Entrepreneurs, managers, institutional representatives, university professors, and experienced professionals are invited to participate as guest speakers in the lecture, in order to deepen, thanks to their professional experience, specific course topics and/or case law cases. IV. Individual study. Students are recommended a number of textbooks and legal websites, which are instrumental in the development of autonomous learning skills. V. Teaching attendance. Attendance of the course is not compulsory. |
| Assessment methods | The assessment process for students attending the Private Law of the Web course will be structured as follows: |
| Other information | Students are supported individually in their exam preparation through tutoring activities that take place throughout the academic year. Erasmus students are invited to weekly meetings in order to check their understanding of the topics, to encourage comparison with similar institutions in their home country, also by comparison with colleagues, and to refine their technical legal language. They may, at their discretion, take the final examination in English. Master's thesis The Master's thesis consists of an individual analysis of one of the legal institutes addressed in the course, the specific topics of which are agreed upon with the lecturer-reporter who, on the basis of the preferences expressed by the student and together with the co-rapporteur, will supervise the preparation of the thesis. In particular, the thesis must demonstrate the critical, literary, technical and scientific maturity corresponding to the specific cultural and professional figures of the Master's degree course and must be elaborated in an original manner by the student. |
| Detailed syllabus | The course is structured as follows: - Web and the person; - Web, social networks and rights of the person; - Web and dematerialisation of real rights: new goods and new 'wealth'; - Web and contractual activity.
