    Nel corso si affrontano i seguenti argomenti:

    1.1. I temi saranno esaminati sotto l'aspetto normativo nazionale e comunitario
    2. Profili comunitari e gli aiuti di Stato
    3. I poteri regionali e l’autonomia finanziaria degli enti locali
    3.1. Il tema del federalismo fiscale

    Obiettivi formativi

    Il corso si prefigge di fornire agli studenti delle nozioni di diritto tributario concernenti la fiscalità di favore per determinate aree geografiche ovvero determinate tipologie di attività. La complessa tematica inevitabilmente deve prendere spunto dalla normativa nazionale e dalla normativa comunitaria. Da un lato si parte dallo studio del federalismo fiscale e dell’autonomia legislativa delle Regioni, dall’altro il tema deve essere affrontato sotto l’aspetto della normativa comunitaria. Il punto di partenza dello studio è che per fiscalità di vantaggio si intende l'insieme delle norme atte a fornire vantaggi di natura fiscale per lo svolgimento di attività economiche in particolari aree svantaggiate di una Regione Europea.
    Allo studente si permette di effettuare delle ricerche in ambito legislativo nazionale e comunitario così da consentire un approccio anche telematico. In tal modo lo studente può essere sensibilizzato nello sviluppo del sapere anche in maniera autonomia.
    Difatti lo studente sarà messo in condizioni di nell’elaborazione di soluzioni di problem solving secondo una logica imprenditoriale, manageriale e/o consulenziale, a specifiche situazioni “critiche” esemplificative dei problemi che possono caratterizzare l’ambito di riferimento della disciplina; di sperimentare, in maniera professionale e/o consulenziale, la propria capacità di comunicazione delle analisi effettuate e delle soluzioni elaborate; di apprendere ed interpretare in maniera autonoma documenti, sentenze, organigrammi, report utilizzati nelle imprese, nelle aziende, nelle pubbliche amministrazioni

    Prerequisiti

    La conoscenza delle fonti del Diritto tributario e di alcuni temi del Diritto comunitario

    Metodologie didattiche

    La didattica si basa sulla seguente articolazione:
    Modalità di svolgimento delle lezioni con partecipazione attiva dello studente.
    Testimonianze applicative: sono invitati a partecipare come relatori ospiti alla lezione, per approfondire, grazie alle loro esperienze imprenditoriali e professionali, e casi giurisprudenziali;
    Simulazioni, gruppi di lavoro e case study: gli studenti sono divisi in gruppi e affrontano un case study. Agli studenti saranno forniti dei casi giurisprudenziali che dovranno essere esaminati dal gruppo di studenti e poi portati all’attenzione degli altri frequentanti il corso;
    Presentazioni e esposizione in aula: i lavori di gruppi saranno presentati in aula con il coordinamento mio in qualità di docente, aprendo una discussione e un confronto fra le diverse ipotesi.
    Studio individuale: agli studenti sono suggeriti alcuni libri di testo, siti web giuridici, funzionali allo sviluppo di autonome capacità di apprendimento.

    Metodi di valutazione

    La prova sarà orale e consiste nell’analisi individuale dei testi obbligatori e del testo di lettura consigliato e domande relative ad all’oggetto delle testimonianze svoltesi durante il corso.
    i candidati dovranno dimostrare:
    a) il possesso di adeguate conoscenze e capacità di comprensione delle problematiche tributarie oggetto del programma;
    b) il possesso di adeguate conoscenze e capacità di elaborazione e comunicazione degli aspetti pratici oggetto del programma.

    Course objectives

    The course aims to provide students with knowledge of tax law on taxation of favor for certain geographic areas or certain types of activities. The complex issue inevitably has to take its cue from national rules and legislation. On the one hand it start from the study of fiscal federalism and legislative autonomy of the regions, on the other hand the issue needs to be addressed from the standpoint of Community law. The starting point of the study is that for tax advantages is the set of rules to provide tax advantages for the development of economic activities in certain deprived areas of the European Region.
    The student is allowed to perform searches in national and EU legislative framework so as to allow even telematics approach. In this way the student can be sensitized in the development of knowledge even in an autonomy.
    In fact, the student will be put in a position in the development of problem solving solutions according to business logic, management and / or consulting, to specific "critical situations" examples of the problems that can characterize the reference framework of the discipline; to experience, in a professional manner and / or consulting, its analysis and communication skills made elaborate solutions; to learn and independently interpret documents, sentences, organization charts, reports used in businesses, companies, public administration

    Teaching methods

    The teaching is based on the following breakdow:

    with active student participation.
    Testimonials application: they are invited to participate as guest speakers
    to lecture, to deepen, thanks to their business and professional experiences,
    cases and case law;

    Simulations, workshops and case studies: Students are divided into groups
    and tackle a case study. Students will be provided of jurisprudential cases to
    be
    examined by the group of students and then brought to the attention of
    others attending the course;

    Presentations and exposure in the classroom: the work of the groups will
    be presented in the classroom with my co

    ordination as a teacher, opening a

    ssion and a comparison between the different hypotheses.

    Evaluation methods

    The test will be oral and consists
    in individual analysis of the compulsory
    texts and recommended reading text and questions relating to the object of
    the evidence held during the course.
    Candidates will need to demonstrate:
    a) sufficient knowledge and understanding of tax issues covered b
    y the
    program capacity;
    b) possession of adequate knowledge and ability to process and
    communication of the practical aspects covered by the program.
