Contenuti | Il corso di Diritto Privato è volto a consentire agli studenti l’apprendimento delle fondamentali nozioni del diritto privato, ossia gli istituti che regolano i rapporti tra i privati e tra i privati e P.A. nei casi in cui quest'ultima agisca come soggetto privato e senza l'esercizio dei poteri autoritativi che le sono propri. La conoscenza degli istituti fondamentali del Diritto Privato ha il fine di consentire l'acquisizione degli strumenti necessari per interpretare i testi di legge e comprendere i meccanismi che governano il ragionamento giuridico. Particolare attenzione sarà posta al diritto delle obbligazioni e dei contratti, determinanti istituti nella formazione sia del professionista con funzioni di gestione nell’ambito pubblico e privato sia di coloro che, volendo proseguire gli studi, intendano acquisire competenze per lo svolgimento dell'attività di revisori contabili, dottori commercialisti e professionisti di impresa. Centrale, quindi, il ruolo della circolazione giuridica e degli strumenti mortis causa e inter vivos ai quali l'ordinamento affida la produzione e lo scambio di beni e servizi. |

Metodi di valutazione | La prova di esame consiste in una prova orale da cui sia possibile per il docente valutare il grado di comprensione, assimilazione e applicazione degli istituti giuridici approfonditi sempre in ottica critica, nonchè di analisi individuale di un caso giurisprudenziale individuato dal docente in sede di esame e nel rispondere sia a domande ad esso relative (domande soglia - minimo ineludibile) sia a altre domande relative al programma. L’esame può essere superato solo nel caso in cui lo studente risponda in maniera sufficiente alle domande soglia con il voto minimo di 18 e il voto massimo di 30 e lode. |

Contents | The course of Private Law is aimed at allowing students to learn the basic notions of private law and the institutions that govern relations between private individuals and between private and P.A. in cases where the latter acts as a private subject and without the exercise of authoritative powers that are its own. Knowledge of the fundamental institutes of Private Law is intended to enable the acquisition of the tools necessary to interpret the texts of law and understand the mechanisms that govern the legal reasoning. Particular attention will be paid to the law of obligations and contracts, which are crucial institutions in the training of both professionals with management functions in the public and private sectors and those who, wishing to continue their studies, wish to acquire skills for the performance of the activities of auditors, accountants and business professionals. Therefore, the role of the legal circulation and of the instruments mortis causa and inter vivos to which the legal system entrusts the production and exchange of goods and services is central. |
Textbook and course materials | Students should only study the parts of the program that are indicated by the teacher at the beginning of the course. It's essential in the study and preparation of the exam consult an updated civil code that students are invited to bring into the classroom during the lessons. Additional case study materials will be distributed during the course. |

Evaluation methods | The examination for students consists of an oral test from which it is possible for the teacher to assess the degree of understanding, assimilation and application of the legal institutions always in depth from a critical point of view, as well as individual analysis of a case identified by the case law of the teacher during the examination and in answering both questions relating to it (threshold questions - minimum unavoidable) and other questions relating to the program. The exam can only be passed if the student sufficiently answers the threshold questions with a minimum grade of 18 and a maximum grade of 30 cum laude. |
Other information | Students are assisted individually in the preparation of the exam through the tutoring activity that takes place throughout the academic year. |
